A 30-year-old labourer, Khalid Yusuf, is to spend 12 months in prison for stealing car battery worth N30,000, a Karmo Grade 1 Area Court in Abuja ruled on Monday.
Delivering judgment, Justice Abubakar Sadiq said the defendant had pleaded guilty to the charge and
the court had no option than to sentence him accordingly.
Sadiq, however, denied the convict an option of fine “because he was not a first time offender.”
He, therefore, sentenced Yusuf to 12 months in prison, adding that the punishment would serve as deterrent to others.
Yusuf of no fixed address was sentenced on three-count charge of joint act, criminal trespass and theft.
Earlier, the prosecutor, Dalhatu Zannah, had informed the court that Bala Gambo of Kings Court Estate, Abuja, reported the matter at the Life Camp Police Station on Sept. 17.
Zannah said that Yusuf and two others now at large on the same date at about 6 p.m. dishonestly trespassed into Gambo’s’s compound.
He said the convict and his partners stole Gambos’s car battery worth N30,000 and cooking gas cylinder valued N12,000.
He added that the complainant raised an alarm which attracted people around and the convict was caught but his accomplices escaped with the items.
He noted that during police investigation, the convict admitted committing the offence but efforts to recover the stolen items proved abortive.
The prosecuting counsel said the offences contravened section 70, 348 and 287 of the Penal Code.
